What is GDPR?<\/strong><\/p>\n

The General Data Protection Regulation (GDPR) is a binding legislative act that is directly applicable in full in the Republic of Croatia and in other member states of the European Union from May 25, 2018.<\/p>\n

The goal of the General Data Protection Regulation is to protect the personal data of natural persons, provide citizens with control over their personal data and create a high and uniform level of personal data protection in the European Union.<\/p>\n

What is personal data?<\/strong>
\nPersonal data is all data relating to an individual whose identity has been determined or can be determined. An identifiable individual is a person who can be identified directly or indirectly.<\/p>\n

United Fiber d.o.o. for telecommunications services (“United Fiber”) has established business processes, roles and responsibilities to ensure compliance with the fundamental principles of personal data protection listed below.<\/p>\n

Legal and fair processing<\/strong>
\nUnited Fiber processes personal data only if and to the extent that at least one of the following is achieved:
\na) The processing of personal data is necessary for the execution of a contract in which the respondent is a party or in order to take actions at the request of the respondent before concluding the contract;
\nb) Processing of personal data is necessary to comply with United Fiber’s legal obligations;
\nc) The respondent has given his consent to the processing of his personal data;
\nd) The processing of personal data is necessary for the realization of the legitimate interests of United Fiber or a third party;
\ne) The processing is necessary to protect the key interests of the data subject or other natural person;
\nf) The processing is necessary for the performance of a task of public interest or for the performance of the official authority of the United Fiber company.<\/p>\n

United Fiber processes special categories of personal data only when at least one legal basis from the above paragraph and at least one legal basis for processing a special category of personal data are met:
\na) the respondent has given express consent to the processing of personal data for one or more specific purposes and the same is not prohibited by applicable regulations;
\nb) processing is necessary for the purposes of fulfilling the obligations and exercising the special rights of the United Fiber company or the respondent in the field of labor law and social security rights and social protection to the extent that this is approved by applicable regulations and which prescribes appropriate protective measures for fundamental rights and interests of the respondents
\nc) processing is necessary to protect vital interests of the respondent or another individual if the respondent is physically or legally unable to give consent;
\nd) the processing is carried out as part of the legitimate activities with appropriate protective measures of a foundation, association or other non-profit body with a political, philosophical, religious or trade union objective e provided that the processing refers only to members or former members of the body or to persons who have regular contact with it in connection with its purposes and that personal data are not disclosed to anyone outside that body without the consent of the subject;
\ne) the processing refers to personal data that is evidently published by the respondent;
\nf) processing is necessary for the establishment, exercise or defense of legal claims or whenever courts act in a judicial capacity;
\ng) processing is necessary for the purposes of significant public interest on the basis of applicable regulations, which is proportional to the desired goal and which respects the essence of the right to data protection and provides appropriate and special measures to protect the fundamental rights and interests of the data subject;
\nh) processing is necessary for the purposes of preventive medicine or occupational medicine for the purpose of assessing the employee’s work capacity, medical diagnosis, provision of health or social care or treatment or management of health or social systems and services based on current regulations or in accordance with a contract with a health worker and in in accordance with the conditions and protective measures;
\ni) processing is necessary for the purpose of public interest in the field of public health, such as protection from serious cross-border threats to health or ensuring high standards of quality and safety of health care and medicines and medical products, based on current regulations prescribing appropriate and special measures for protection the rights and freedoms of respondents, especially the preservation of professional secrecy;
\nj) processing is necessary for the purposes of archiving in the public interest, for the purposes of scientific or historical research or for statistical purposes on the basis of applicable regulations that is proportionate to the goal sought to be achieved and which respects the essence of the right to data protection and provides appropriate and specific measures for protection of fundamental rights and interests of respondents<\/p>\n

United Fiber will not start processing personal data until it has been ensured that the processing is lawful and fair.<\/p>\n

Transparency of processing<\/strong>
\nTransparency of processing is one of the fundamental principles that United Fiber applies to ensure the protection of personal data of respondents. Complete and unambiguous information is the basis for establishing trust between United Fiber and the respondents.
\nTransparency implies clear and unambiguous communication of personal data processing to data subjects before or at the beginning of the data processing cycle, at the time of collection of personal data from data subjects or personal data obtained in another way, during the entire processing period, during communication with data subjects about their rights and at certain moments during duration of processing.
\nUnited Fiber establishes business processes with associated roles and responsibilities that enable data subjects to exercise their rights related to the processing of their personal data in accordance with applicable regulations at any time. United Fiber enables the exercise of the respondent’s rights free of charge. If the respondent’s requests are clearly unfounded or excessive, especially due to their frequent repetition, United Fiber may charge a reasonable fee taking into account the administrative costs of processing the request or refuse to process the request.<\/p>\n

Limiting the purpose of processing<\/strong>
\nUnited Fiber processes personal data of respondents exclusively for a specific and lawful purpose and does not further process them in a way that is inconsistent with the purpose for which they were collected, unless otherwise prescribed by law or based on the consent of the respondent. In the event of a business need for the use of personal data for a purpose different from that initially envisaged, the subject will be informed about such processing and its legality before the start of personal data processing.<\/p>\n

Reduction of the amount of personal data<\/strong>
\nUnited Fiber takes measures to ensure the processing of those personal data that are relevant, essential, appropriate and limited to what is necessary for the purposes for which the personal data is processed.<\/p>\n

Data accuracy<\/strong>
\nUnited Fiber attaches great importance to the quality of the personal data it processes so that they are accurate, complete and up-to-date for the purpose of protecting the personal data of the respondents and preventing possible misuse of data and the appropriate provision of services and sales of products.
\nUnited Fiber takes appropriate organizational and technical measures to ensure the quality and accuracy of personal data that is processed.
\nIt is the respondent’s responsibility to provide accurate and up-to-date information as required by United Fiber. United Fiber establishes processes for updating personal data and invites respondents to provide timely notification of the need to change or correct personal data.
\nPersonal data found to be incorrect or incomplete in any way will be updated, supplemented or deleted in a timely manner.<\/p>\n

Limited data processing and storage time<\/strong>
\nUnited Fiber processes and stores personal data of respondents only for as long as it is necessary to fulfill a specific legal purpose, unless the applicable regulations provide for a longer or shorter storage time for a particular purpose or in other cases in accordance with the applicable regulations.
\nWith the aim of quality management of personal data, United Fiber determines the period of data storage and takes measures for their protection and deletion, destruction or anonymization of data after the expiration of the time period prescribed for data storage.<\/p>\n

Security of personal data<\/strong>
\nUnited Fiber takes appropriate measures to ensure secure data processing, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage.<\/p>\n

Probability and responsibility<\/strong>
